Terms of service for electronic services provided on SeniorMap.eu, prepared under Art. 8 of the Polish Act of 18 July 2002 on providing services by electronic means.

The Polish version of these terms is the binding one. This English version is provided for convenience.

1. General provisions

  1. SeniorMap.eu (the "Service") is run by Michał Śnieżyński, Szymany 16a/3, 12-100 Szymany, Poland, tax ID (NIP) 9532621635, REGON 367799390 (the "Provider" or "we").
  2. Contact: email hello@seniormap.eu, postal address: [correspondence address]. This email address is also the single point of contact for users and authorities under Articles 11 and 12 of the Digital Services Act (Regulation (EU) 2022/2065). We communicate in Polish and English.
  3. Definitions:
    • User: anyone using the Service.
    • Family: a User looking for care for themselves or a family member who sends a Request.
    • Care home: a care home, social welfare home, senior residence or other care provider described in the Directory.
    • Care home account: an account in the care home panel, linked by us to at least one Care home.
    • Directory: the public list of Care homes in the Service.
    • Request: a description of care needs sent by a Family through the form in the Service.

2. Types and scope of services

We provide the following electronic services:

  1. Directory: searching and browsing information about Care homes, including on a map. No data is required.
  2. Care request: sending a description of needs, passing it in anonymised form to matching Care homes, collecting their replies and, at your request, passing your contact details to a Care home you choose.
  3. Care home submission: sending information about a Care home to the Directory, including photos.
  4. Care home panel: for Care home accounts, including viewing matching Requests, setting which Requests to receive and replying to them.
  5. Emails related to the above services (for example a verification code, reply notifications, a sign-in link).

All current services are free of charge.

3. Technical requirements

To use the Service you need:

  1. a device with internet access,
  2. an up-to-date web browser with JavaScript and the cookies necessary for the Service enabled,
  3. an active email address to send a Request or sign in to the care home panel.

Using the internet carries common risks such as malware or phishing. We never ask for passwords or payment details by email. The link to your private Request page and the sign-in link are meant only for you.

4. Rules of use

  1. Providing unlawful content is prohibited, including content that infringes personal rights, copyright or data protection law, or that is misleading.
  2. Users agree to:
    • provide truthful information,
    • not provide other people's data without a legal basis, in particular health data without the knowledge of the person concerned where they can be asked,
    • not disrupt the Service, bypass its security or collect data from the Service automatically for further use,
    • not use the Service to send advertising or unsolicited offers.
  3. We may remove content or restrict access to a service if a User breaches these terms or the law. The rules are set out in sections 9 and 10.

5. Care requests

  1. The Request form asks about the type of care, location, start date, general independence, mobility and memory (in simple categories), budget, funding and preferences, as well as your first name, email and optionally phone number.
  2. To send a Request, you accept these terms and the privacy policy and consent to the processing of health information for matching Care homes.
  3. A Request becomes active after you confirm your email address with a 6-digit code. After 5 wrong attempts the code stops working. A new code can be sent at most 3 times.
  4. A Request is visible to Care homes that are published in the Directory, operate in Poland, are linked to a Care home account and match the region and type of care. The Care home whose page the Request was sent from always sees it too. Care homes see only an anonymised summary, without your contact details.
  5. At most 5 Care homes can reply to one Request. You see the replies on your private Request page.
  6. You decide whether, and with which Care home, to share your contact, always one at a time. After you share it, the Care home may contact you directly.
  7. A Request is active for 30 days. You can close it earlier on your private Request page.
  8. The Service does not guarantee that a Care home will reply or will have a place available.

6. Care homes and Care home accounts

  1. Submitting a Care home is free. Our editors review submissions before publishing. We may ask for more information, correct obvious errors, refuse publication or remove a listing that is untrue, out of date or breaches these terms. Photos may be uploaded only if you hold the rights to them and they do not show identifiable residents without their consent.
  2. We link a Care home account after checking that the person may represent the Care home. Sign-in works through a link sent by email.
  3. A person using a Care home account confirms they are authorised to act on behalf of the Care home.
  4. When replying to a Request, a Care home:
    • gives accurate information about availability, price and conditions of care,
    • does not try to identify the Family before the contact is shared,
    • after receiving the contact, uses it only to discuss the care the Family asked about, does not send advertising without consent and does not pass the data to others,
    • from the moment the contact is shared, is a separate controller of the Family's data and is responsible for processing it in line with the GDPR.
  5. Order in the Directory: Care homes are listed alphabetically by name, within the filters chosen by the User (for example region, town, type of care). We do not offer paid highlighting or paid changes in order. If this changes, we will describe the new rules in these terms.
  6. Who receives a Request: Requests go to Care homes based on the regions and types of care set in the care home panel (by default, the data in the listing), and always to the Care home whose page the Request was sent from. A Care home can pause receiving Requests. Which Care homes reply is decided by the order of replies until the limit of 5 replies is reached.
  7. Fees: replying to Requests is currently free. We may introduce paid features for Care homes in the future. We will do so only after amending these terms and notifying Care home accounts by email at least 15 days in advance, with prices stated before they apply. Fees will never apply to actions taken before the change takes effect, and using paid features will require a separate, explicit decision by the Care home. Free use of the Service creates no obligation to buy anything.

7. Nature of the Service and liability

  1. The Service is a directory and an intermediary for the first contact. We do not provide care or medical services, do not give health advice and are not a party to agreements between Families and Care homes.
  2. Information about Care homes comes from Care homes, people submitting them, public sources and our editors. We try to keep it up to date but do not guarantee it is complete. A listing in the Directory does not confirm the quality of care or that the Care home holds the required permits. Before making a decision, check the Care home directly, including its entry in the relevant voivode's register.
  3. A Care home may ask us to correct or update its listing by writing to us.
  4. We make efforts to keep the Service running without interruptions, but technical breaks may occur, for example during updates.
  5. This section does not exclude or limit any liability towards consumers that cannot be excluded or limited by law.

8. Conclusion and termination of contracts

  1. The contract for using the Directory is concluded when you start using the Service and ends when you stop using it.
  2. The contract for handling a Request is concluded when you send the Request form and ends when the Request is closed or expires.
  3. The contract for a Care home account is concluded when the account is linked and lasts until it is deleted.
  4. You can stop using a service at any time, without giving a reason and at no cost: close your Request or ask us by email to delete the Care home account. A consumer may also withdraw from the contract within 14 days of concluding it without giving a reason, by sending us a statement by email.
  5. We may terminate a Care home account contract with 30 days' notice, sending the reasons by email. In case of a serious or repeated breach of these terms or the law (for example using Families' data contrary to section 6.4), we may block the account with immediate effect, also with a statement of reasons.

9. Reporting illegal content

  1. If you believe the Service contains illegal content or content that breaches these terms, write to hello@seniormap.eu. Your report should include: an explanation of why the content is illegal, the exact page address (URL), your name and email, and a statement that you are reporting in good faith and the information is accurate.
  2. We will confirm receipt, assess the report without undue delay and inform you of our decision.
  3. If we remove or restrict content or an account, we will send the person concerned a statement of reasons, including the grounds for the decision and how to appeal. An appeal can be sent by email. We will decide on it within 14 days.
  4. We do not use automated tools to moderate content. Reports are assessed by a person.

10. Complaints

  1. You can make a complaint about how the Service works by email to hello@seniormap.eu or by post to: [correspondence address].
  2. Describe what the complaint is about and give an email address for the reply.
  3. We will reply within 14 days of receiving the complaint, in the same way it was made, unless you ask otherwise.
  4. Consumers in Poland can get free help from municipal or district consumer ombudsmen, consumer organisations and out-of-court dispute resolution by the voivodeship Trade Inspection. Information is available at prawakonsumenta.uokik.gov.pl.
  5. Care homes can make complaints in the same way, including about a restriction or suspension of an account. We handle them free of charge within 14 days.

11. Personal data

How we process personal data is described in the privacy policy. The providers that process data on our behalf are listed on the Subprocessors page.

12. Changes to these terms

  1. We may change these terms for important reasons, such as changes in the law, changes in the scope of services, the introduction of paid features or the need to improve security.
  2. We will announce changes on this page and, for people with an active Request or a Care home account, by email at least 15 days before the changes take effect. If you do not accept the changes, you can stop using the service during that time.
  3. Requests sent before a change are handled under the previous rules.

13. Final provisions

  1. These terms are governed by Polish law. This choice of law does not deprive consumers of the protection given by mandatory provisions of the country where they habitually reside.
  2. Disputes are resolved by the courts competent under general rules.
  3. Provisions concerning consumers also apply to a natural person concluding a contract directly related to their business activity, where the contract shows it is not of a professional nature for them, to the extent provided by law.
  4. These terms apply from 9 October 2026.
